The training given to police officers when they are recruited have not sufficiently imparted into their minds the fact that a ‘persons should be deemed to be innocent until he is proved guilty by the due process of law’, as spelt out in the UN Human Rights Convention. The incapability of the police to use their intelligence to investigate into crimes and their scant regard for the fundamental rights of a person taken into custody, coupled with the sadistic mentality of many policemen has led to torture becoming rampant in Sri Lanka.

Gone are the days when Magistrates referred suspects brought before them to be remanded, to be taken for medical examination if he sees any indication of the suspect being in pain. The days when medical examinations in such cases were done diligently, are also no more. Invariably there had been hardly any cases of torture by Police Officers being filed in the Courts, in spite of the much maligned provisions of the Torture Prevention Act, which ironically provides for complaints of torture to be investigated by the Police themselves .

Repeated reports by many, including the UN Special Rapporteur on Torture, have highlighting the widespread prevalence of torture of persons taken into custody. have had no effect on anyone concerned. Yet, it is commendable that many human rights organisations in and out of Sri Lanka , continue to conduct their own investigations and highlight grave instances of torture of persons taken into custody and often help them to get some relief.
